On the evening of December 17th , a three-judge panel of the US Court of Appeals for the 6th Circuit reinstated the OSHA ETS mandate for businesses with 100 or more employees. 


OSHA will begin fining large employers as early as January 10th for failing to track vaccination status or enforcing a mask mandate for unvaccinated workers. 


The US Labor Department will begin issuing citations as early as February 9th for failure to comply with the testing requirements (or sooner if the employer is not “exercising reasonable, good faith efforts to come into compliance” with the rule). 


The mandate requires the employees of large employers to be fully vaccinated against COVID-19 or undergo weekly testing. The Labor Department, however, has hinted that the 100-employee threshold is meant to be “a stepwise” approach to curbing the spread of COVID-19, meaning it is considering applying the mandate to employers with less than 100 employees.
